What Is IRLJ 3.2?

IRLJ 3.2 outlines what happens when a defendant fails to appear at a requested hearing on a traffic infraction. The rule has two parts:

(a) Entry of Judgment

  • The court must enter judgment against you.
  • The judgment will state that you committed the infraction.
  • You will be assessed any monetary penalties that apply by law.

⚠️ Exception: If the court determines from the records that the case was filed in the wrong court, it cannot enter judgment.

(b) Setting Aside a Judgment

  • You show good cause for your failure to appear.
  • You make the request under Civil Rule CRLJ 60(b), which allows judgments to be reversed for reasons like mistake, excusable neglect, or newly discovered evidence.
